Harvey Weinstein, the disgraced entertainment mogul, is facing a new trial after his previous rape conviction was overturned, leading to his return to prison. Weinstein, who arrived at Rikers Island jail following the conviction reversal, was later hospitalized at Bellevue.
During his first court hearing post the rape conviction reversal, Weinstein appeared in a wheelchair in person. The proceedings, which were mostly procedural, resulted in the judge remanding Weinstein to prison. His lawyer, Arthur Aidala, expressed concerns about Weinstein’s health, stating that he required significant physical assistance.
Manhattan District Attorney Alvin Bragg pushed for Weinstein’s remand, emphasizing the office’s intention to swiftly retry the film producer on sexual assault charges. Bragg expressed confidence in securing another conviction against Weinstein.
The court scheduled a discovery hearing for May 29, with Weinstein’s new trial tentatively set for after Labor Day. The decision to overturn Weinstein’s 2020 rape conviction came on April 25, following a 4-3 ruling by a New York appeals court. The court found fault with the trial judge for allowing unrelated accusations against Weinstein to be presented in court.
Weinstein had previously been sentenced to 23 years in prison for offenses including forcing oral sex on a production assistant and third-degree rape of a hairstylist. Despite being acquitted of certain charges, the legal battle continues for the controversial figure.
